Maithripala’s petition against TV adverts

The Colombo District Court yesterday gave time till January 5, 2015 to the Sri Lanka Rupavahini Corporation and three other television stations to file objections to an application for an Interim injunction filed by common opposition candidate at the forthcoming Presidential polls Maithripala Sirisena.
The plaintiff Sirisena has said these TV stations telecast a speech made by him, in 2009 in which he praised President Rajapaksa. He had alleged that it was in violation of presidential election laws to advertise an extract of a speech made a couple of years ago.
He wants the advertisement stopped by an injunction of the Court. On Friday last, the District Judge Ms. Sujatha Alahapperuma had refused to grant the enjoining order against the respondents and fixed the hearing of the plaint. When the case was called before Additional District Judge Ms. Kumari Abeyratne yesterday, the respondent TV Stations and other connected respondents were given time to file objections.Ali Sabry PC appeared for the defendants. Ronald Perera PC appeared for the plaintiff.

ඔබයි අපේ රජා, ඔබ අපට දෙවියෙක්‌ ආදී වැකි ඇතුළත් ජනාධිපති මහින්ද රාජපක්‍ෂ මහතාගේ ගුණ වර්ණනා කරමින් තමා පැවැත්වූ කතාවක්‌ නැවත විකාශනය කිරීම වළක්‌වන වාරණ නියෝගයක්‌ දෙරණ, ශ්‍රී ලංකා රූපවාහිනිය, හිරු සහ ස්‌වර්ණවාහිනිය යන විද්යුත් මාධ්‍ය ආයතනවලට නිකුත් කරන්නැයි ජනාධිපතිවරණ පොදු අපේක්‍ෂක මෛත්‍රීපාල සිරිසේන මහතා කළ ඉල්ලීමක්‌ කොළඹ දිසා අධිකරණ විනිසුරු සුජාතා අලහප්පෙරුම මහත්මිය ප්‍රතික්‍ෂේප කළාය.
මෛත්‍රීපාල සිරිසේන මහතා විසින් එම මාධ්‍ය ආයතන 4 ට එරෙහිව පැවරූ නඩුවකින් කළ එම අතුරු ඉල්ලීම ප්‍රතික්‍ෂේප කිරීමට විනිසුරුවරිය තීරණය කළේ දෙපාර්ශ්වයේම නීතිඥවරු ඉදිරිපත් කළ කරුණු සලකා බැලීමෙන් අනතුරුවය.
සිරිසේන මහතා සිය පැමිණිල්ලෙන් කියා සිටියේ තමා 2009 වසරේදී පැවැත්වූ එම කතාව මේ ජනාධිපති මැතිවරණයේදී තමාට එරෙහිව ප්‍රචාරක අවියක්‌ ලෙස යොදා ගැනීම හා නැවත විකාශනය කිරීම ජනාධිපති අපේක්‍ෂකයන් විසින් පිළිපැදිය යුතු බවට මැතිවරණ කොමසාරිස්‌ නිකුත් කළ උපදෙස්‌ උල්ලංඝනය කිරීමක්‌ බවයි.
සිරිසේන මහතා කළ කතාව එකී නාලිකා ඔස්‌සේ විකාශනය කෙරෙන්නේ මුදල් ගෙවා පළ කළ දැන්වීමක්‌ ලෙසයි.ජනාධිපති නීතිඥ රොනල්ඩ් පෙරේරා මහතා සිරිසේන මහතා වෙනුවෙන් පෙනී සිටි අතර ජනාධිපති නීතිඥ අලිසබ්රි ක්‌වේරා ද සොයිසා ඇතුළු නීතිඥවරු පිරිසක්‌ විත්ති පක්‍ෂයට පෙනී සිටියහ.මෙම නඩුව ජනවාරි 05 වැනිදා යළි කැඳවීමට ද නියම කෙරිණි.
